Types of Child Care Programs
Choosing the right child care is an important decision, and understanding your options can help you make the best choice for your family:
The New York State Office of Children and Family Services has regulations that govern the minimum requirements for all modalities of child care. These requirements have been developed in accordance with NYS Social Services Law 390, to protect the health and safety of children cared for outside their home by someone other than a relative.
Types of Child Care Programs
Licensed & Registered Programs
Family Day Care Home
This type of care is offered in a caregiver’s home and provides supervision for children for more than three hours a day. It serves between three and six children at a time. Additionally, up to two more school-age children can be cared for if they attend only before or after school, during lunch, on school breaks, or when school is not in session.
Group Family Day Care Home
This program also takes place in a caregiver’s home and serves between seven and twelve children of various ages for more than three hours a day. It may also care for up to four extra school-age children during before- or after-school hours, lunch, school holidays, or when school is out for summer or other breaks.
Child Day Care Center
A child day care center is a non-residential facility that regularly cares for more than six children, each for over three hours a day.
School-Aged Child Care Program​
This program operates in a non-residential setting and provides care for groups of seven or more children under the age of 13. It is designed to support families during the school year by offering care before and/or after school, during lunch breaks, school holidays, and throughout the summer. These programs align with the local school calendar.

Legally Exempt Programs
Legally Exempt Child Care
Is an option For Families. The office of chidren and family services, division of child care services allows parents/caretakers to hire individuals to care for their child(ren). this is known as legally exempt child care. A legally eempt provider is not required to be licensed or regitered to provide child care. Families eligible for Child Care assistance can choose this type of care, but the legally exempt provider/program must enroll with an enrollment agency to be paid.
A legally exempt child care provider can be someone tha the parent/caretaker is famiiar with like a friend, a neighbor, family or someone else known to the family. Care can be provided in the child(ren)'s home, your home or in another residence.
How To Apply To Be A Legally Exempt Provider
A family who is eligible for CCAP can say that they want to use a legally exmpt provider. They wil be given an enrollment packet which must be completed bu the family as well as the provider. The enrollment forms are then returned to the enrollment agency (EA) which starts the enrollment process
What Does An Enrollment Agency Do?
A New York state contracted enrollment agency (EA) can help a prospective provider enroll to provide legally exempt child care. They can provide technical assistance eligibiity and share information about the regulatory requirements you must follow in order to be enrolled.
